Terms of Service

These Terms of Service ("Terms") govern your access to and use of Jettson.ai and all associated services ("Service"), operated by RWX-TEK INC ("Company," "we," "us," "our"), a California corporation.

BY ACCESSING OR USING JETTSON, YOU AGREE TO THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICE.

If you are using Jettson on behalf of an organization, you represent and warrant that you have authority to bind that organization, and "you" refers to both you individually and that organization.

1. Acceptance and Eligibility

1.1 Acceptance

Your use of Jettson constitutes your agreement to these Terms, our Privacy Policy, and our Cookie Policy, all incorporated herein by reference.

1.2 Age Requirement

You must be at least 18 years old to use Jettson. We do not knowingly provide services to individuals under 18. If we discover a user is under 18, we will terminate their account and delete their data.

1.3 Legal Capacity

You represent that you have full legal capacity and authority to enter into these Terms under the laws of your jurisdiction.

2. Service Description

Jettson provides an AI-powered workspace platform including:

  • AI Studio — AI chat assistants, deep research, and content generation tools
  • Developer Tools — MCP server builder, API access, and documentation
  • Integrations — Connections to Gmail, Google Calendar, Microsoft Outlook, Telegram, and other third-party services
  • Lead & CRM Tools — Lead capture, contact management, and enrichment

We reserve the right to modify, expand, or discontinue any part of the Service at any time. We will provide 30 days' notice for material discontinuations where reasonably practicable.

3. User Accounts

3.1 Account Creation

You must provide accurate, complete, and current information. You are responsible for maintaining accurate account information.

3.2 Account Security

You are solely responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity occurring under your account
  • Immediately notifying us of any unauthorized access at customertek@rwxtek.com

We are not liable for losses resulting from unauthorized use of your account credentials.

3.3 Account Suspension and Termination

We may suspend or terminate your account immediately, without notice, for:

  • Violation of these Terms or our Acceptable Use Policy
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Activity that poses security, legal, or reputational risk to the Service
  • Any reason at our sole discretion, with or without cause

Upon termination, your access ends immediately. We will retain your data for 30 days before deletion, during which you may export your data by contacting us.

4. AI Services — Disclosure, Limitations, and Token Usage

4.1 Nature of AI Outputs

Jettson uses artificial intelligence and large language models to generate responses, research, and content. AI outputs are generated automatically and may be:

  • Inaccurate, incomplete, outdated, or misleading
  • Inconsistent across requests for similar queries
  • Inappropriate for professional, legal, medical, or financial reliance

AI OUTPUTS DO NOT CONSTITUTE LEGAL, MEDICAL, FINANCIAL, TAX, OR ANY OTHER PROFESSIONAL ADVICE. You must consult qualified professionals before acting on AI-generated content for any important decision.

4.2 AI Token and Usage Limits

  • AI features are subject to token limits, message quotas, and rate limits based on your subscription plan
  • Token and message limits reset on a monthly basis as specified in your plan
  • Exceeding limits may result in service degradation, pausing of AI features, or additional charges
  • We do not guarantee unlimited AI processing under any plan
  • Paid message add-ons ("refills") are non-refundable once consumed
  • We reserve the right to adjust AI model availability, token limits, and feature access with 30 days' notice

4.3 AI Agent Actions

  • You are solely and fully responsible for all actions taken by Jettson AI Agent on your behalf, including all emails sent, calendar events created, Telegram messages sent, and any other communications
  • You must comply with CAN-SPAM and any other applicable anti-spam or communications laws when using AI email or messaging features
  • We are not liable for any unauthorized, incorrect, harmful, or unintended communications generated by AI features

4.4 Human Oversight Requirement

For any consequential use of AI outputs — including but not limited to sending communications, making business decisions, or publishing content — you must exercise human review and judgment. Automated use of AI outputs without human oversight is at your sole risk.

5. Subscriptions, Payments, and Billing

5.1 Pricing

Current pricing is available at jettson.ai/pricing. All fees are in USD and exclude applicable taxes, including VAT, GST, and sales tax where applicable.

5.2 Subscription Terms

  • Subscriptions are billed monthly or annually in advance
  • Payment is processed via Stripe
  • You authorize us to charge your payment method on file automatically at the start of each billing period
  • Failed payments may result in immediate service suspension

5.3 Price Changes

We may change subscription prices with 30 days' written notice. Price changes take effect at your next renewal. Continued use after a price change constitutes acceptance.

5.4 Taxes

You are responsible for all taxes, duties, and levies associated with your use of Jettson in your jurisdiction. We will add applicable taxes where required by law.

5.5 Refund Policy

  • We do not offer refunds except as expressly stated below or as required by applicable law
  • If we terminate your account for reasons other than a Terms violation, we will refund the pro-rata unused portion of your current billing period
  • Voluntary cancellations take effect at the end of the current billing period; no partial refunds apply

EU/EEA Users — Statutory Right of Withdrawal: If you are located in the EU or EEA, you have a 14-day right of withdrawal from your initial subscription purchase. To exercise this right, contact customertek@rwxtek.com within 14 days of your initial purchase. This right does not apply to renewals or if you have materially used the Service during the 14-day period.

Australian Users: Refunds may be available under the Australian Consumer Law where the Service fails to meet statutory guarantees.

Brazilian Users: Refunds for online purchases may be available under the Brazilian Consumer Defense Code (CDC) Article 49 within 7 days of purchase for remote contracts.

5.6 Disputes and Chargebacks

You agree to contact us at customertek@rwxtek.com before initiating a chargeback or payment dispute. Fraudulent chargebacks may result in account termination and referral to collections.

6. Service Availability

We use commercially reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable from time to time due to maintenance, third-party provider outages, or events beyond our reasonable control. We are not liable for any losses or damages arising from Service unavailability or downtime. Status updates are published at status.jettson.ai.

7. User Content

7.1 Ownership

You retain all ownership rights to content you create, upload, or process through Jettson.

7.2 License Grant

You grant RWX-TEK INC a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your content solely to provide and improve the Service.

7.3 Your Responsibility

You are solely responsible for ensuring your content:

  • Does not violate any applicable law or regulation
  • Does not infringe any third-party intellectual property rights
  • Does not violate any person's privacy rights
  • Complies with GDPR, CCPA, and other applicable data protection laws if it contains personal data of others

7.4 Prohibited Content

You may not submit content that:

  • Contains malware, viruses, or malicious code
  • Is illegal, defamatory, threatening, abusive, or obscene
  • Infringes intellectual property rights
  • Contains unsolicited commercial communications (spam)
  • Violates export control or sanctions laws
  • Contains personal data of minors under 18
  • Is designed to deceive, manipulate, or defraud

7.5 Takedown Rights

We may remove any content that violates these Terms, applicable law, or that we reasonably believe poses legal or security risk, with or without notice.

8. Acceptable Use and Bot/Automation Policy

8.1 Permitted Use

Jettson is provided for lawful business and personal productivity use.

8.2 Prohibited Activities

You may not:

  • Violate any applicable law or regulation, including export controls and sanctions
  • Use Jettson to generate spam, phishing content, or deceptive material
  • Attempt to reverse-engineer, decompile, or extract our source code or AI models
  • Scrape or extract data from Jettson beyond authorized API access
  • Use automated bots, scripts, or tools to abuse the Service, circumvent limits, or gain unfair advantage
  • Launch denial-of-service attacks, credential stuffing, or other automated attacks against Jettson
  • Attempt to bypass, circumvent, or defeat rate limits, security controls, or authentication
  • Resell or sublicense access to Jettson without written authorization
  • Mine cryptocurrency through Jettson infrastructure
  • Use Jettson to develop a competing product by training models on our outputs
  • Facilitate unauthorized access to third-party systems through Jettson integrations

8.3 Rate Limits and Fair Use

  • AI features are subject to rate limits enforced at the API level
  • Deliberate circumvention of rate limits (including through multiple accounts) is prohibited
  • We may throttle, suspend, or terminate access for abuse of Service resources

8.4 Bot and Automated Request Policy

Automated access to Jettson must use the authorized API with valid credentials. Unauthorized automated scraping or access to web interfaces is prohibited and may be blocked without notice.

9. Intellectual Property

9.1 Our IP

Jettson, including its name, logo, code, design, documentation, and underlying AI systems, is owned by RWX-TEK INC and protected by U.S. and international copyright, trademark, and trade secret laws. All rights not expressly granted are reserved.

9.2 DMCA / Copyright Claims

To report copyright infringement, contact our designated DMCA Agent:

9.3 Trademark

"Jettson," "Jettson AI," and "JETTSON_" are unregistered trademarks of RWX-TEK INC, claimed under U.S. common law through use in commerce. You may not use these marks without our prior written consent.

10. Third-Party Services and Integrations

Jettson integrates with third-party services including Anthropic, OpenAI, Firebase, Stripe, Apollo.io, Google, Microsoft, and Telegram. Your use of these integrations is subject to their respective terms of service. We are not responsible for third-party service availability, accuracy, or compliance.

11. Privacy and Data Protection

Your use of Jettson is governed by our Privacy Policy, which is incorporated herein. We process your data in accordance with applicable privacy laws including GDPR and CCPA/CPRA. See our Privacy Policy at jettson.ai/privacy.

12. Disclaimers

12.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED AVAILABILITY.

12.2 AI Disclaimer

WE DO NOT WARRANT THAT AI OUTPUTS ARE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR ANY PURPOSE. AI IS AN ASSISTIVE TOOL ONLY.

12.3 Third-Party Disclaimer

WE ARE NOT RESPONSIBLE FOR THE AVAILABILITY, ACCURACY, OR CONTENT OF THIRD-PARTY SERVICES, APIS, OR DATA PROVIDERS.

13. Limitation of Liability

13.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RWX-TEK INC SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Business interruption, even if we have been advised of the possibility of such damages

13.2 Liability Cap

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO JETTSON SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

13.3 Essential Basis

THE LIMITATIONS IN THIS SECTION REFLECT THE ALLOCATION OF RISK AND ARE AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND RWX-TEK INC. THEY APPLY REGARDLESS OF THE LEGAL THEORY OF LIABILITY.

13.4 Jurisdictional Limitations

Some jurisdictions do not allow exclusion of certain warranties or limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

Australian Users: Nothing in these Terms limits rights under the Australian Consumer Law that cannot be excluded.

EU/EEA Users: Nothing in these Terms limits liability for gross negligence, fraud, personal injury caused by negligence, or any other liability that cannot be excluded under applicable EU law.

14. Indemnification

You agree to indemnify, defend, and hold harmless RWX-TEK INC, its officers, directors, employees, contractors, and agents from all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of Jettson
  • Your content or AI agent actions
  • Your violation of these Terms or applicable law
  • Your violation of any third-party rights
  • Any claim by your end users arising from your use of Jettson

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.2 Mandatory Arbitration

EXCEPT AS PROVIDED IN SECTION 15.4, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION — NOT IN COURT.

  • Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules or Commercial Arbitration Rules, as applicable
  • Arbitration shall take place in Los Angeles County, California, or remotely by mutual agreement
  • The arbitrator's decision is final and binding, and may be entered as a judgment in any court of competent jurisdiction
  • YOU WAIVE YOUR RIGHT TO A JURY TRIAL
  • YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION

15.3 Small Claims Exception

Either party may bring an individual claim in small claims court if the claim qualifies.

15.4 Injunctive Relief Exception

Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent imminent harm, without waiving the right to arbitrate the underlying claim.

15.5 International Users

If you are located outside the United States, you agree that disputes will still be governed by California law and resolved by AAA arbitration in Los Angeles, California. Nothing in this Section affects any mandatory statutory rights you may have under your local law.

EU/EEA Consumers: If you are an EU/EEA consumer, you may also contact your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/odr. The arbitration clause does not prevent you from asserting mandatory EU consumer law rights.

16. Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to:

  • Natural disasters, fires, floods, earthquakes, or extreme weather
  • War, terrorism, civil unrest, government actions, or sanctions
  • Pandemic, epidemic, or public health emergency
  • Electrical grid failures, telecommunications outages, or internet disruptions
  • Cyberattacks, DDoS attacks, or malicious interference by third parties
  • Failures of third-party infrastructure providers (cloud hosting, AI APIs, payment processors)
  • Regulatory or judicial actions restricting our operations
  • Labor disputes or supply chain disruptions

During a force majeure event, our obligations are suspended to the extent affected. We will notify you as soon as reasonably practicable.

17. General Provisions

17.1 Modifications

We may update these Terms at any time. Material changes will be communicated via email or prominent Service notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance. If you do not agree to changes, you may cancel your subscription before the effective date.

17.2 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and RWX-TEK INC regarding the Service and supersede all prior agreements.

17.3 Severability

If any provision is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions remain in full effect.

17.4 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

17.5 Assignment

You may not assign these Terms or your account without our prior written consent. We may assign these Terms to any successor, acquirer, or affiliate without your consent.

17.6 No Relationship

These Terms do not create any partnership, joint venture, employment, or agency relationship between you and RWX-TEK INC.

17.7 Language

These Terms are written in English. Translations are provided for convenience only. In case of conflict, the English version controls.

18. Jurisdiction-Specific Provisions

18.1 California Residents

In addition to rights under CCPA/CPRA (see Privacy Policy), California residents may have additional rights under California consumer protection law. Contact us at customertek@rwxtek.com to exercise any California-specific rights.

18.2 European Union / EEA Residents

If you are in the EU/EEA, you have a 14-day statutory right of withdrawal from your initial purchase (Section 5.5). The arbitration clause does not prevent you from relying on mandatory EU consumer protection laws, and you may lodge complaints with your national data protection authority.

18.3 Other International Users

If you are outside the United States or EU/EEA, mandatory consumer-protection rights granted to you by your local law continue to apply notwithstanding anything in these Terms. Contact us at customertek@rwxtek.com to exercise any local rights.
