Terms of Service

Welcome to Jettson. These Terms of Service ("Terms") govern your access to and use of Jettson.ai ("Service"), operated by RWX-TEK INC ("Company", "we", "us", "our"), a California corporation.

By accessing or using Jettson, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using any part of Jettson (including MCP hosting, AI Studio, or any other features), you agree to:

  • These Terms of Service
  • Our Privacy Policy
  • Our Acceptable Use Policy
  • All applicable laws and regulations

If you are using Jettson on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

Jettson provides:

2.1 MCP Server Hosting

  • Cloud deployment of Model Context Protocol (MCP) servers
  • Automated infrastructure management via Fly.io
  • Server monitoring and management tools

2.2 AI Studio

  • AI-powered chat assistants
  • Deep research and content generation
  • Lead capture and CRM tools
  • Integration with third-party data providers

2.3 Developer Tools

  • API access
  • Documentation and support resources

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Accounts

3.1 Account Creation

  • You must provide accurate, complete, and current information
  • You must be at least 18 years old to use Jettson. Jettson is not available to users under 18
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity under your account

3.2 Account Security

  • You must immediately notify us of any unauthorized use
  • We are not liable for losses caused by unauthorized use of your account
  • You may not share, transfer, or sell your account

3.3 Account Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Any reason at our sole discretion

4. User Content and MCP Servers

4.1 Your Content

  • You retain ownership of content you upload to Jettson
  • You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content as necessary to provide the Service
  • You are solely responsible for your content and MCP servers

4.2 Prohibited Content

You may not upload, deploy, or distribute:

  • Malware, viruses, or malicious code
  • Content that violates intellectual property rights
  • Content that is illegal, harmful, threatening, abusive, defamatory, or obscene
  • Content that violates privacy or data protection laws
  • Spam, phishing attempts, or fraudulent material
  • Content designed to mine cryptocurrency without disclosure
  • Content that violates export control laws

4.3 MCP Server Responsibility

  • YOU ARE SOLELY RESPONSIBLE FOR CODE YOU DEPLOY
  • We do not review, monitor, or control MCP server code before deployment
  • You must comply with all applicable laws, including those of your jurisdiction and your users' jurisdictions
  • You indemnify us against any claims arising from your MCP servers or content

4.4 Agent Actions

  • You are solely responsible for all actions taken by Jettson Agent on your behalf, including all emails sent, calendar events created, and communications made
  • Jettson is not liable for any unauthorized, incorrect, or harmful communications sent by the Agent
  • You must review Agent-generated communications before they are sent when possible, and accept full responsibility for automated sends
  • You must comply with CAN-SPAM, GDPR, CASL, and all applicable email laws when using the email send feature
  • Jettson is not a HIPAA Business Associate and is not HIPAA-compliant. Do not connect healthcare email accounts containing protected health information (PHI). Healthcare providers subject to HIPAA must not use Jettson with PHI without a signed Business Associate Agreement

4.5 Resource Limits

  • MCP servers are subject to resource limits based on your plan
  • We may throttle, suspend, or terminate servers that exceed limits
  • We may remove servers that cause infrastructure issues

4.5 Takedown Rights

We reserve the right to remove any content or MCP server that:

  • Violates these Terms
  • Infringes intellectual property rights (see DMCA section)
  • Poses security or legal risks
  • Receives valid legal demands for removal

5. Payments and Subscriptions

5.1 Pricing

  • Current pricing is available at jettson.ai/pricing
  • Prices are subject to change with 30 days' notice
  • All fees are in USD and exclude applicable taxes

5.2 Billing

  • Subscriptions are billed monthly or annually in advance
  • Payment is processed via Stripe
  • You authorize us to charge your payment method on file
  • Failed payments may result in service suspension

5.3 Refunds

  • We do not offer refunds except as required by law. If we terminate your account for reasons other than a Terms violation, we will refund the unused portion of your current billing period on a pro rata basis
  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period
  • No partial refunds for unused time when you voluntarily cancel

EU/EEA Customers: If you are located in the European Union or European Economic Area, you have the right to withdraw from your subscription within 14 days of your initial purchase for a full refund. To exercise this right, contact support@jettson.ai within 14 days of your purchase date.

5.4 Free Trials and Promotions

  • Free trials and promotional offers are subject to additional terms
  • We may modify or terminate promotions at any time
  • Trials convert to paid subscriptions unless cancelled

6. Intellectual Property

6.1 Our IP

  • Jettson, its logo, design, code, and documentation are owned by RWX-TEK INC
  • You may not copy, modify, distribute, or reverse-engineer our Service
  • All rights not expressly granted are reserved

6.2 Your IP

  • You retain ownership of your content and MCP servers
  • You are responsible for ensuring you have rights to all content you upload

6.3 DMCA / Copyright Infringement

If you believe content on Jettson infringes your copyright, contact us at:

7. Third-Party Services

7.1 Integrations

Jettson integrates with third-party services including:

  • Fly.io (infrastructure)
  • Stripe (payments)
  • Firebase (data storage)
  • OpenAI, Anthropic (AI models)
  • Apollo.io (lead data)

You are responsible for complying with third-party terms of service.

7.2 Third-Party Data

  • AI Studio may use third-party data providers
  • Data accuracy is not guaranteed
  • We are not responsible for third-party data quality or availability

7.3 External Links

  • Jettson may contain links to third-party websites
  • We are not responsible for external content or services

8. Disclaimers and Limitations of Liability

8.1 NO WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability
  • Uninterrupted or error-free operation
  • Security or data integrity

8.2 LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • WE ARE NOT LIABLE FOR DATA LOSS, REVENUE LOSS, PROFIT LOSS, OR BUSINESS INTERRUPTION
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM
  • WE ARE NOT LIABLE FOR USER CONTENT, MCP SERVERS, OR THIRD-PARTY SERVICES

8.3 AI-Generated Content

  • AI outputs may be inaccurate, incomplete, or inappropriate
  • You are responsible for reviewing and verifying AI-generated content
  • We are not liable for decisions made based on AI outputs

8.4 MCP Server Risks

  • YOU DEPLOY MCP SERVERS AT YOUR OWN RISK
  • We do not guarantee server uptime, performance, or security
  • We are not responsible for server failures, data loss, or security breaches
  • You are responsible for backing up your data

9. Indemnification

You agree to indemnify, defend, and hold harmless RWX-TEK INC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of Jettson
  • Your content or MCP servers
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Any claim that your content or servers caused harm

10. Privacy and Data Protection

10.1 Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your data. By using Jettson, you agree to our Privacy Policy.

10.2 Data Processing

  • We process data as necessary to provide the Service
  • You are responsible for obtaining user consent for data you collect
  • You must comply with GDPR, CCPA, and other applicable privacy laws

10.3 Security

  • We implement reasonable security measures
  • WE DO NOT GUARANTEE ABSOLUTE SECURITY
  • You are responsible for securing your MCP servers and data

11. Acceptable Use

You agree NOT to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Deploy malicious code or exploits
  • Attempt to access unauthorized systems or data
  • Interfere with the Service or other users
  • Use the Service to send spam or phishing attempts
  • Scrape, data-mine, or reverse-engineer the Service
  • Resell or redistribute the Service without authorization
  • Use the Service for cryptocurrency mining (except disclosed, authorized use)
  • Violate export control or sanctions laws

12. Termination

12.1 By You

  • You may cancel your subscription at any time from your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months

12.2 By Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account poses security or legal risks
  • We discontinue the Service

12.3 Effect of Termination

Upon termination:

  • Your access to Jettson ends immediately
  • Your MCP servers will be deleted
  • You remain liable for any outstanding fees
  • Sections 4, 6, 8, 9, and 13 survive termination

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

13.2 Arbitration

ANY DISPUTE ARISING FROM THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING ARBITRATION, NOT COURT LITIGATION.

  • Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA)
  • Arbitration shall take place in Los Angeles County, California
  • You waive the right to a jury trial
  • You waive the right to participate in class actions

13.3 Exceptions

Either party may seek injunctive relief in court for:

  • Intellectual property infringement
  • Violation of confidentiality obligations
  • Urgent security or legal threats

13.4 Small Claims Court

You may bring claims in small claims court if they qualify.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RWX-TEK INC.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

14.3 Waiver

Our failure to enforce any right does not waive that right.

14.4 Assignment

You may not assign these Terms. We may assign them to any successor or affiliate.

14.5 Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, strikes, government actions, infrastructure failures, etc.).

14.6 Modifications

We may update these Terms at any time. We will notify you of material changes via email or Service notice. Continued use after changes constitutes acceptance.

15. Developer-Specific Terms

15.1 MCP Hosting

  • MCP servers are deployed to third-party infrastructure (Fly.io)
  • You are responsible for ensuring your code complies with Fly.io's terms
  • We may change infrastructure providers at any time
  • We reserve the right to inspect MCP server code if necessary for security or legal compliance

15.2 API Usage

  • API access is subject to rate limits and quotas
  • We may revoke API access for abuse or violation of Terms
  • API terms may be updated separately

15.3 Open Source

  • Jettson may use open-source components
  • Your MCP servers may use open-source libraries (you are responsible for compliance)

16. Studio-Specific Terms

16.1 AI Outputs

  • AI-generated content is provided as-is without accuracy guarantees
  • You are responsible for reviewing and verifying AI outputs
  • We do not claim ownership of AI-generated content, but you grant us the license described in Section 4.1

16.2 Lead Data

  • Lead data is provided by third-party sources
  • Data accuracy is not guaranteed
  • You must comply with anti-spam laws (CAN-SPAM, GDPR, etc.) when contacting leads
  • We are not responsible for data quality or legal compliance

16.3 CRM Data

  • You are responsible for securing your CRM data
  • We are not liable for data loss or unauthorized access
  • You must obtain proper consent to store contact data

BY USING JETTSON, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
